What is compliance?

So, the core services FCS (Facilities Compliance Services ) offer relate to Electrical compliance. But what is compliance, and why should you be bothered about it?

There are 3 tiers of legislation that relate to directly to this, the first of which is,

The Health & Safety at Work Act (NI) 1974 (Law under which you can be prosecuted) which states “It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees” 

The next document is,

The Electricity at Work Regulations (NI ) 1991. Of which Reg. 4(1) states:  Every employer shall ensure that work equipment is so constructed or adapted to be suitable for the purpose for which it is used or provided for. 

And finally,

BS:7671 British Standard (Sometimes confusingly referred to as ‘The Regs’). This document is non-statutory but is the reference guide used to determine compliance. Note this is a minimum standard required.

This is the document used by the electrical industry in the design, installation and compliance of electrical systems (The electricians bible in theory)

In summary if you are a landlord, business owner or manager in charge you are deemed a ‘duty holder’ in the eyes of the law. As such it is your duty ‘as far as is reasonably practicable’ to ensure the safety of tennant/staff under the ‘Health & Safety at Work Act’.

The only way to prove that you have taken all reasonable steps is by having up to date records of maintenance and safety checks as required by local authorities or guidance set out in BS:7671 Guidance note 3.
